Terms of Use Agreement

Introduction:

Our online store welcomes you and informs you that below you will find the terms and conditions governing your use of this store and all legal effects resulting from your use of the store"s services via this electronic platform. Using the store—whether as a consumer of the store"s service or product, or otherwise—constitutes approval and acceptance while possessing full legal capacity as recognized by Sharia, regulations, and laws for all articles and provisions of this agreement. It also confirms your commitment to its regulations and contents. This agreement applies to all types of dealings between the consumer and the store. It is considered effective and binding upon your approval and initialization of registration with the store pursuant to Article 10 of the Saudi Electronic Transactions Law.

Article 1 – Introduction and Definitions

The above preamble is an integral part of this agreement. Below are the meanings and definitions of the main terms used herein:

  1. (The Store): Includes all forms of the store on the World Wide Web, whether an electronic application, a website, or a commercial establishment.

  2. (The Consumer): Any person engaging in e-commerce seeking to obtain products or services provided by the store through its electronic platform.

  3. (The Agreement): Refers to the terms and conditions of this agreement, which govern and regulate the relationship between the parties hereto.

Article 2 – Consumer Legal Capacity

  1. The consumer acknowledges possessing full legal capacity recognized by Sharia and applicable regulations to deal with the store, or that they are at least eighteen (18) years of age.

  2. The consumer agrees that in the event of violating this article, they shall bear the consequences of such violation against third parties.

Article 3 – Nature of Obligation

  1. The store’s obligation toward consumers is to provide the (Service or Product).

  2. The store may provide other services, such as after-sales services or related offerings, depending on the nature and type of the (Service or Product) requested by the consumer.

Article 4 – Usage Controls

  1. The consumer undertakes to use the store"s electronic platform in compliance with public morals and applicable laws in the Kingdom of Saudi Arabia.

  2. Upon purchasing a service or product from this store, the consumer undertakes not to use said service or product in any manner that violates public morals or applicable regulations in the Kingdom of Saudi Arabia.

Article 5 – Accounts and Registration Obligations

Upon applying for membership in this store as a user, you are obligated to disclose specific information and select a user name and secret password to access the store"s services. By doing so, you agree to:

  1. Be responsible for maintaining the confidentiality of your account information and password, and agree to immediately notify the store of any unauthorized use of your account details or any other breach of your confidential data.

  2. The store shall under no circumstances be liable for any direct or indirect, moral or material loss incurred by you due to the disclosure of your user name or login password.

  3. You are obligated to use your account or membership with the store yourself, as you are fully responsible for it. If used by someone else, it shall be presumed that you authorized them to use the store in your name and on your behalf.

  4. You agree to use the store with total seriousness and credibility.

  5. You agree to disclose real, accurate, current, complete, and lawful information about yourself as required during registration with the store, and undertake to update your data if it changes in reality or when needed.

  6. Our store undertakes to treat your personal information and contact details with strict confidentiality.

  7. If it appears to the store that you disclosed untrue, inaccurate, outdated, incomplete, unlawful information, or information violating the Terms of Use, the store reserves the right to suspend, freeze, or cancel your membership, store, or account on the platform, without prejudice to other rights and legitimate means of the store to recover its rights and protect other consumers.

  8. In case of non-compliance with any of the above, the store management has the right to suspend or cancel your store or membership, or block you from accessing the store"s services again.

Article 6 – Electronic Communications and Official Means of Communication

  1. The parties to this agreement agree that communication shall be conducted via the email registered on the platform.

  2. The consumer agrees that all agreements, announcements, statements, and other communications provided electronically replace their written counterparts, standing as valid legal evidence in meeting legal and Sharia requirements.

  3. The consumer agrees to the possibility of being communicated with and notified of any provisions concerning this agreement or dealings through general broadcasts sent by the store management to all consumers or specific users.

Article 7 – Amendments to Terms of Use and Fees

  1. If any article or clause in this agreement is canceled or becomes unenforceable, such circumstance shall not invalidate the remaining articles, clauses, rules, and provisions contained herein, which shall remain effective until further notice from the store management.

  2. This agreement—which may be amended from time to time as necessary—constitutes the working mechanism, understanding, and contract between the (Consumer) and the (Store).

  3. The store may impose fees on certain consumers depending on the offers, products, or services requested, or state-imposed fees or taxes related to the nature of the product or service.

  4. The store reserves the right to add, increase, decrease, or deduct any fees or expenses under the articles, clauses, and terms of the agreement on any consumer, regardless of their registration reason.

Article 8 – Payment and Settlement Services

  1. The store provides payment and settlement systems through its partners entirely online via available payment options on the store or through any other method the store provides from time to time.

  2. The store is committed to setting the price of the service or product displayed in its store according to recognized market value.

  3. The store undertakes to provide invoices, payment vouchers, and receipt vouchers for all amounts arising in its store, and promises to issue the consumer a purchase invoice for any product or service.

  4. The store undertakes to provide standard accounting specifications in its online platform in application of this agreement, given its legal, economic, commercial, and regulatory benefits.

Article 9 – Intellectual Property

  1. Intellectual property rights related to the store are fully owned by the store, whether owned prior to or after establishing this electronic platform.

  2. The consumer respects the intellectual property rights of the store, including the store’s name, words, logos, and other symbols owned or displayed by it, as all rights following the store name belong fully as intellectual property to the store.

Article 10 – Store Liability

  1. The store undertakes to conduct its business through this electronic platform legally and in accordance with applicable regulations in the Kingdom of Saudi Arabia and the provisions of this agreement.

  2. The store assumes no liability for claims arising from errors or negligence, whether direct, indirect, accidental, caused by the consumer, or by a third party such as shipping companies.

  3. The store, its personnel, owners, and representatives undertake that the (Product or Service) shall be sound, lawful, authorized under the laws of Saudi Arabia, and used for legitimate purposes.

Article 11 – Access and Membership Restriction

The store may suspend or cancel a consumer"s membership or restrict their access to platform services at any time, without prior notice, and for any reason without limitation.

Article 12 – Applicable Law and Jurisdiction

This Terms of Use Agreement is governed by, drafted, and fully subject to the laws, regulations, and legislation in force in the Kingdom of Saudi Arabia.

Article 13 – General Provisions

If any article or clause in this Terms of Use agreement is invalidated or no longer enforceable, it shall not cancel the validity of the remaining articles, clauses, and provisions, which remain effective until further notice from store management.

This Terms of Use Agreement—as amended from time to time—constitutes the agreement, working mechanism, understanding, and contract between the store and the consumer. Both parties agree to consider the following:

  1. Arabic is the official language when interpreting or translating the provisions of this agreement into another language.

  2. All prices displayed for services or products may be modified from time to time.

  3. Promotional or marketing offers provided by the store are temporary, and the store reserves the right to modify or discontinue them at any time.

  4. Both parties undertake to deal with each other without violating Sharia principles, laws, and regulations governing the nature of consumer-store dealings.

  5. This agreement shall not be canceled except by a decision issued by the store management.
